# Terms of use

**English version.** These terms are the English version of the French *Conditions Générales d'Utilisation et de Vente*. They are a translation: should the two versions differ, the French text prevails.

**Publisher:** Mirubiki is published by Green Greens SAS, a French company with a share capital of 2,000 euros, registered with the Bobigny Trade and Companies Register under number 891 258 345, whose registered office is at 23 avenue Jacques Demolin, 93150 Le Blanc Mesnil, France.

**EU VAT number:** FR20891258345 **Website:** [https://mirubiki.com](https://mirubiki.com) **Support:** [contact@greengreens.fr](mailto:contact@greengreens.fr) **Last updated:** 19 October 2026

## 1. Purpose

These terms govern access to and use of the Mirubiki platform, published by **Green Greens**, a French SAS with a share capital of 2,000 euros, registered with the Bobigny Trade and Companies Register under number 891 258 345.

## 2. Access to the service

Access requires a valid account. Information given at sign-up must be accurate and complete. Users agree not to create fake accounts or to impersonate a third party.

## 3. What the service is, and what it is not

Mirubiki answers a questionnaire with synthetic personas built from public survey data, and reports on the quality of the questionnaire: items that do not measure what they claim, wording that pushes an answer, scales that collapse, segments that break.

It is not, and must not be read as:

- a probability sample. It produces no incidence, market share or margin of error, and it does not measure a population;

- a substitute for a fielded panel. Its output is a diagnosis of the instrument, not an estimate of the population;

- real testimony. Its answers are synthetic, describe no real individual, and must not be presented as the answers of real respondents.

## 4. Data and content

Questionnaires you submit remain yours. Data generated and processed through the platform is subject to applicable personal data protection law. Green Greens does not resell or share user data without explicit consent. See the [privacy policy](/us/confidentialite).

## 5. Intellectual property

All content of the platform (texts, images, logos, code) is the exclusive property of Green Greens and is protected by French and international intellectual property law. Unauthorised reproduction is prohibited.

## 6. Liability

Green Greens makes reasonable efforts to keep the platform running but cannot be held liable for interruptions or malfunctions beyond its control. Users remain responsible for the use they make of the service and for the decisions they take from its output.

## 7. Changes to these terms

Green Greens may modify these terms at any time. Users will be informed of changes by any appropriate means. The date of the current version appears above.

# Terms of sale

## Article 1 — Purpose and scope

These terms of sale govern all contractual relations between the publisher of Mirubiki.com and any person or entity (the **Customer**) wishing to subscribe to a plan in order to use the platform for generating surveys with artificial intelligence.

The platform is intended in the first place for professional customers acting in the course of their commercial, industrial, craft or liberal activity (the **Business Customer**). These terms also apply to any individual subscribing as a consumer (the **Consumer**).

Subscribing to a plan entails full and unreserved acceptance of these terms by the Customer.

## Article 2 — Definitions

**Platform:** the Mirubiki.com website and online interface allowing the Customer to design and generate surveys, questionnaires or forms using artificial intelligence models.

**Subscription:** the paid contract taken out by the Customer to access the features and/or credits of the platform, on the plan and billing cycle chosen at checkout.

**Generated Content (Output):** all questionnaire answers, textual structures and statistics produced by the platform's artificial intelligence in response to the Customer's requests.

**Input Data:** the instructions, topics, questions or texts provided by the Customer on the platform to guide the generation of content.

## Article 3 — Subscription and access

### 3.1 Order process

The Customer selects a plan on the site, creates an account, enters the required information and pays online. The order is firm and final once payment is validated by the third-party payment provider, evidenced by immediate opening of access rights on the platform and by a confirmation email.

### 3.2 Accuracy of information

The Customer agrees to provide accurate and up-to-date identity, contact and billing information when registering. The publisher cannot be held liable for the consequences of incorrect information (for example, access emails not received, or errors on the invoices generated).

## Article 4 — Right of withdrawal

### 4.1 Consumers in the European Union

Under Article L.221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not delivered on a tangible medium where performance has begun after the consumer's prior express agreement and express waiver of the right of withdrawal. By validating the subscription on the platform and immediately accessing the survey generation services and credits, the Consumer **expressly requests immediate performance of the service and therefore formally waives the fourteen (14) day right of withdrawal.**

### 4.2 Business customers

No right of withdrawal applies to Business Customers.

### 4.3 Customers outside the European Union

Nothing in these terms limits a mandatory right of withdrawal or cancellation you may have under the law of your country of residence.

## Article 5 — Prices, invoicing and payment

### 5.1 Prices and taxes

Prices are shown on the platform. The currency, the amount and the taxes applicable to your order are displayed at checkout, before payment.

- **Business Customers:** prices are quoted excluding tax. Applicable VAT is calculated at checkout according to the country of establishment of the business and to a valid EU VAT number where one is provided.

- **Consumers:** the final price shown at payment includes all taxes at the rate in force in the Customer's country of residence.

The publisher may change its prices at any time. New prices apply only to future renewal periods of the Subscription.

### 5.2 Payment and invoicing through Stripe

Payment is made online by card (or any other secure payment method offered) through the third-party payment provider **Stripe**. Card details are fully encrypted and processed by Stripe; they never pass through, nor are they stored on, the publisher's servers. By validating payment, the Customer authorises Stripe to charge the initial subscription amount and subsequent automatic renewals. A compliant invoice, issued and managed by Stripe, is sent automatically by email after each successful transaction.

## Article 6 — Term, renewal and termination

### 6.1 Term and renewal

The Subscription is taken out for the term chosen at checkout (monthly or annual). It renews automatically for successive periods of the same length, unless the Customer terminates it.

### 6.2 Self-service termination through the customer portal

The Customer can manage the Subscription independently. Automatic renewal can be stopped at any time, at no cost, from the **Stripe customer portal** made available in the account area of the platform. Any period already started remains due and no pro-rata refund is made; the Customer keeps access to paid features until the end of the current billing period.

### 6.3 Suspension or termination by the publisher

The publisher may terminate the Subscription or suspend the Customer's account as of right, without notice and without compensation, in the event of a serious breach of these terms by the Customer (in particular non-payment or abusive use).

## Article 7 — Intellectual property

### 7.1 Ownership of the platform

The Mirubiki.com platform, its source code, its design, its graphical interface, its proprietary algorithms, its brand and its databases are the exclusive property of the publisher and are protected by copyright and intellectual property law. No right of use other than SaaS access is granted to the Customer.

### 7.2 Ownership and use of Generated Content

The publisher assigns to the Customer, without geographical restriction and for the whole term of protection of the rights, all rights of exploitation, reproduction and representation over the survey and questionnaire structures generated by the platform from the Customer's requests. **The Customer is free to use, distribute, integrate into its own materials or commercialise the Generated Content.**

The Customer acknowledges, however, that because of the nature of artificial intelligence technologies (large language models), similar or identical results may be generated for other users making equivalent requests. The publisher therefore cannot guarantee the exclusivity or absolute originality of the Generated Content.

## Article 8 — Liability and disclaimer of warranty

### 8.1 Probabilistic nature of AI

The Customer expressly acknowledges that the platform relies on large language models of a generative and probabilistic nature. The publisher therefore cannot warrant that the questions or surveys produced are free of errors, textual bias, factual inaccuracies or misinterpretations.

### 8.2 Limitation of warranties

The service is provided "as is". The publisher does not warrant:

- the total absence of temporary interruptions of the service (maintenance, third-party network failures or API saturation);

- the perfect suitability of the service to the Customer's specific business requirements.

The Customer remains solely responsible for proofreading, semantic validation, verification of legal compliance and final distribution of the surveys generated to its own users or clients.

### 8.3 Cap on liability

Except in cases of gross negligence or wilful misconduct, the publisher's total cumulative liability, all causes combined, is expressly limited to the total amount excluding tax actually paid by the Customer during the **twelve (12) months** preceding the damaging event. The publisher shall in no event be liable for indirect damages, loss of business, loss of data, loss of revenue or harm to the Customer's brand image.

## Article 9 — Technological change and infrastructure

The publisher may change at any time and without notice the artificial intelligence models, the language model versions, the third-party providers (APIs) or the technical infrastructure used to operate the service, in order to improve its quality. Such technical changes or model changes give rise to no compensation or refund, provided that the essential survey generation features of the platform remain substantially equivalent.

## Article 10 — Fair use policy and suspension

The publisher enforces strict fair use rules to preserve infrastructure stability and API availability for all users. The following are expressly prohibited:

- the use of unauthorised scripts, robots or automation tools intended to extract data at scale or to flood the platform with requests;

- any attempt at reverse engineering or circumvention intended to extract the system prompts or the internal logic of the tool.

The publisher may apply rate limiting or immediately suspend a Customer's access to the platform, without notice, in the event of proven abusive use. Such suspension for breach gives rise to no refund or compensation.

## Article 11 — Personal data

The publisher processes the Customer's personal data in accordance with the European General Data Protection Regulation (GDPR) and applicable national law. The data collected (name, email address, professional information) is strictly necessary to process subscriptions, manage invoicing and provide the service. The Customer has a right of access, rectification, portability and erasure over their own personal data, which may be exercised at any time by writing to the address above.

Green Greens does not sell personal information. For details on how input data is stored and secured, see the [privacy policy](/us/confidentialite).

## Article 12 — Force majeure

The publisher shall not be liable for delays, access difficulties or contractual non-performance caused by force majeure as defined by Article 1218 of the French Civil Code and the case law of the French courts (including large-scale cyber attacks and general failures of electricity or global telecommunications networks).

## Article 13 — Governing law and jurisdiction

These terms are governed by **French law**.

In the event of a dispute, the parties will first seek an amicable solution before any legal action.

- **If the Customer is a Consumer:** the dispute may be submitted to an approved consumer mediator, in accordance with the French Consumer Code. Failing that, the competent French courts of ordinary jurisdiction apply. A consumer residing in the European Union also keeps the protection of the mandatory rules of their country of residence.

- **If the Customer is a Business Customer:** any dispute relating to the formation, validity, interpretation, performance or termination of these terms falls under the exclusive jurisdiction of the **Commercial Court of the jurisdiction of the publisher's registered office**, notwithstanding multiple defendants or third-party claims.

Version of 19 October 2026.
